What EMTALA actually requires

EMTALA imposes obligations that are distinct from state malpractice standards: an appropriate medical screening examination for anyone who comes to the emergency department, stabilizing treatment within the hospital's capability, and an appropriate transfer when stabilization is not possible.

Confusing an EMTALA violation with a standard-of-care breach is the most common analytical error in these cases, and our reviews keep the two separate throughout.

Screening

Was the medical screening examination appropriate?

Appropriateness is assessed against what the hospital does for similarly presenting patients, using its own protocols and capabilities as the benchmark.

We look at triage documentation, the depth and consistency of the workup, and whether the screening was applied uniformly regardless of insurance status or ability to pay.
