What we examine

Policy and procedure manuals, bylaws, call schedules, committee minutes, incident reports, root-cause analyses, accreditation surveys and corrective action plans are reviewed against the conduct at issue.

The core question is whether written policy, actual practice and the applicable standard were aligned — and if they diverged, whether the institution knew.

Analysis

Individual versus institutional responsibility

Many cases involve a clinician acting within a system that made the error likely. We assess whether the failure was a lapse in individual judgment, a predictable consequence of institutional design, or both.

Corporate negligence, negligent credentialing and vicarious liability theories are addressed on their own terms rather than folded into clinical standard-of-care opinions.

Regulatory Context

Accreditation and compliance frameworks

Opinions are framed against the standards that actually governed the institution: CMS Conditions of Participation, Joint Commission or other accreditation standards, and applicable state licensing requirements.

EMTALA questions are frequently intertwined and can be handled in the same engagement.
